Subject: The applicant, Leoluca Biagio Bagarella, is an Italian national who was born in 1942. He is currently in L’Aquila prison (Italy), where he is serving a life sentence for murders and participation in a mafia-type criminal association. The applicant complained that his correspondence had been monitored by the prison authorities. The Court found unanimously that there had been a violation of Article 8 (right to respect for private and family life) of the European Convention on Human Rights and considered that the finding of a violation constituted in itself sufficient just satisfaction for the non-pecuniary damage sustained by Mr Bagarella.
