Subject: The author examines some of the most recent decisions of the European Court of Human Rights in the field of interference between acquisition of evidence in criminal proceedings and rights of the accused. He traces some guidelines summing up the situation of jurisprudence on the matter. Finally, he underlines, on one side, how these decisions show the nature of the judgments of the Court, and, on the other, some questions concerning the bonds for national judges deriving from the case law in the field of evidence.
