Subject: The Court has deemed as discriminatory the provision, valid only for non Community citizens, that the economical benefit for accompanying elder or disabile people be subject to the possession of the permit of stay (which presupposes income and housing requirements). The Court recalls that, among generally recognized norms of International Law, are included those which, guaranteeing fundamental human rights independently of nationality, forbid discrimination against foreigners who lawfully stay in the territory of the State
